This organization was created to promote the welfare of the residents of OrangeCounty by providing fresh, affordable, and healthy produce, a variety of fresh flowers, and ample opportunity for entrepreneurs to directly sell their healthy fare. The Sustainable Community Foundation of Orange County will dedicate surplus revenues from the Farmer’s Market for scholarship to students residing in the city of Garden Grove. Honor System GGIFCM operates on a percentage of sales system which is in the spirit of supporting small farmers and businesses. Our rates remain competitive with the industry and you will find that permitting fees, advertising, liability insurance, and amenities such as live music are a substantial expense to the organizers of GGICFM. Therefore, GGIFCM reserves the right to refuse stall space and audit any vendor without notice if a vendor is deemed in gross violation of this honor system. Vendors may reapply to participate in GGIFCM after 60 days after been found in violation. Two instances of violation are grounds for permanent disbarment from participation in GGIFCM. Selling Space Guidelines Space Assignment 1) Loss of reserved space for the next market day will result from: a. Voluntary departure by notification to the Manager b. Missing a market day without notifying the Market manager in advance, except for emergencies, which must be explained t the Manager in person or by phone ON THE DAY OF THE MISS OR THE NEXT DAY. Such misses are known as “No Show-No Calls” 2) Loss of Permanent Space will result from: a. Voluntary departure by notification to the Manger b. Absence from a market for 26 consecutive weeks c. Three “No Show-No call” misses in any 6 month period 3) DETERMINATION OF SENIORITY a. Participation in a market during any week earns one seniority point at that market. Farmers required to alternate with another farmer with the same product (such as honey) will receive 2 seniority points for each market appearance. A maximum of 52 points can be earned in any one year (53 if the calendar permits). Such seniority point accumulate from year to year and are used by staff to compute seniority. b. All accumulated seniority will be lost upon: i. 3 No Show-No Call misses in any 6 month period ii. 52 weeks of continuous absence from a market without communication from the Manager. 4) Non-competition: the majority of the vendor product cannot compete with the product of another vendor or products of the business in the immediate vicinity open during market hours. 5) The Farmer’s Market will not be operative in all major religious holidays (Eastern and Christmas). During market hours, all lots must have a minimum of (1) adult (18 or over) manning the booth to serve market customers. Failure to comply shall automatically forfeit the exhibitor’s right to their lot. Their space may then be rented to another exhibitor with no refund to the previous exhibitor.
Assignment – Subletting The parties agree that GGIFM is attempting to have a quality market and desire to insure that the exhibitors have a successful market as well. In order to ensure the success of the market, GGIFM must approve the exhibitor and those items which will be sold or displayed at the festival. To insure GGIFM’s control over the items sold or displayed, the exhibitor agrees not to assign or sublet any portion of the space leased by the exhibitor under this agreement. A vendor agrees that any attempt to assign or sublet shall be caused for revocation of exhibitor’s license to occupy the space and that exhibitor shall forfeit any sums paid by exhibitor to the GGIFM. Parking Vendors may park on Main Street for the market. Additional vendor and customer parking is available in the two parking lots adjacent to Main Street, one to the east and one to the west, as well as along Acacia Street. Security Security will patrol periodically within the booth area during non-market hours. The patrols will start Saturday night until market closing Sunday night. Setting Up All lots will be available 7:30 a.m. Sundays. Vendors may then start setting up for the market at their assigned lots. All vendors must be in place by 9:45 a.m. Sundays. Vendors not set up and ready for business by the designated time will be canceled and the rental fees forfeited. No vehicles will be allowed on the grounds after 9:45 a.m. Sundays. THERE WILL BE NO EXCEPTIONS. Break Down All vendors or displays must be removed from Main Street lot by 3:00 p.m. Sundays. The lots shall be left in the same condition, as when exhibitors occupied them and must be left free of any trash, boxes, displays, or other objects; the booth shall be broom clean. No portion of vendor’s merchandise or displays shall be removed prior to the close of the market. Vehicles will not be allowed to move on the market grounds prior to close of the market. Any vendor who does not clean up after himself or herself shall not be asked to return to the market.
I. Certified farmer’s market commodities sold are limited to: a. Fresh Fruits b. Vegetables c. Dried Fruits d. Fresh and Dried Herbs e. Nuts f. Honey g. Eggs h. House Plants & Cut Flowers II. Every grower using the farmer’s markets’ facilities must file a copy of his certified producer certificate and a signed copy of the market rules with the market manager. III. All commodities sold at the farmer’s market shall meet the requirements of the California Food and Agricultural Code. For commodities that must be weighed, scales or balances are required and must be “sealed” by the county sealer of weights and measures. IV. Peddlers are not permitted to sell at the farmer’s market. No resale of any commodities may be made, and no commissions may be paid or received in connection with sales at the Farmer’s Market. V. Vendors must accept the space assigned by the market manager. One stall space is 10 feet frontage by 15 feet deep. VI. Vendors must maintain the space assigned to them in a clean and sanitary condition, and when vacating slot, vendors must remove from the premises all equipment, fruits, vegetables, trimmings, wrappings, and containers. VII. Products may be sold by grower thereof, a member of his immediate family, or by a paid employee. One certified producer may act for and sell the products of another certified producer (in accordance with state regulations) with the approval of the market manger. VIII. Collusion among growers to raise prices or exertion of any influence, pressure, or persuasion to cause a grower to increase prices is strictly forbidden. IX. Any variation from the foregoing regulations will preclude a grower’s right to use the farm market. The market manager has the authority to enforce these regulations and to exclude nonconforming growers. X. Any person denied the right to sell at the market may appeal to the farmer’s market Appeals Committee.
